Acceptance by the Client of any Rich Book Authors, Service, and or Products indicates the Client's explicit and implicit acceptance of the Terms and Conditions set out herein below and incorporated herein by reference. These terms set out the legal basis as a contractual agreement ("Agreement") upon which Rich Book Authors LLC, DBA (referred to as "RichBookAuthors.com," "We," "Us," or "Our") provides its related services for the Online Sale of Custom Book Writing Packages (collectively, such services, including but not limited to any new packages, content, video, audio, text, graphics, and the "Service(s)"), (these "Terms" or "Terms of Sale") apply to the purchase and sale of services through richbookauthors.com; including any purchases made on or through our affiliate sites, including, but not limited to, webinarjam.com and everwebinar.com, and any other sites that have been named in this document (the "Site"). Along with the Client's order and payment processing for the Services ("Order") take effect when you click the "Accept" button or similar check box presented to you as part of the sign-up process or when you first use the Services, whichever is earlier, and will remain in effect during the relevant Subscription Term or until terminated as specified in the Agreement. If you are entering into this Agreement on behalf of a company or other legal entity you represent, you have the authority to commit the entity to the Agreement. The term "Client" or "You" will refer to that entity. If you do not have this authority, are under the age of 18, or if you disagree with the Agreement, you must not select the "Accept" button or accept these terms, and you may not access or use the Services.

Rich Book Authors will provide the Client with a Welcome Letter, Non-Disclosure, and Springboard Questionnaire at the start of the process. The Client undertakes to read the Welcome Letter properly to understand the process better and fill out the Questionnaire entirely and accurately.

The Rich Book Authors' philosophy centers around a policy of individualized attention and a highly professional team of researchers, interviewers, and writers. In the first phase of the Client ghostwriting process, the Client's discovery questionnaire is submitted to our team of vetted professional interviewers and ghostwriters. Once the match is made, the collaboration begins interview coordinator will arrange the interview schedule for both parties. The interview coordinator will block multi-tiered sixty-minute phone interviews to shape the book's content, structure, tone, and voice.

Rich Book Authors is a service provider and has no employment relationship with the Client. Nothing contained in these Terms and Conditions shall be deemed to constitute a partnership, joint venture, employer/employee agreement, or the like between them.

The Compact Book Package covers the essential parts of your story in four-tiered interviews; the COMPLETE BOOK PACKAGE tells your story in eight-tiered interviews; the FULL-LENGTH BOOK PACKAGE tells your story greater depth and detail. The Client may upgrade to a custom bespoke package by request.

The Client shall provide all the pertinent details and materials for the ghostwriter to perfectly capture your story, voice, tone, and structure to develop a compelling bestselling book in the Client's genre.

The Interview Coordinator schedules the interviews by date and time zone, providing both the Client, interviewer, and or the ghostwriter the digital conference dial-in number and dial-in access to record each sixty-minute tiered interview to be transcribed for the Client and ghostwriter to read and prepare for the next interview session.

Rich Book Authors professional ghostwriter's name does not appear anywhere in the book or the copyright and contractually remain anonymous in perpetuity.

Each Client is assigned a project manager; author management resource, interviewer; interview coordinator, and ghostwriters with authorship, media, and academic credentials.

The questions you submit and the responses you receive do not form the basis for a professional-Client relationship, including but not limited to attorney-client, physician-patient, or therapist-patient, and are not subject to standards or requirements of confidentiality and privilege associated in addition to that. However, Rich Book Authors will do everything possible to respect your privacy and maintain complete confidentiality, except when legal requirements supersede that need.

The timescale from the first interview to producing a professional manuscript in your words and voice is based on the calculation of the total payment or the final installment payment of the Client's Rich Book Author Package based on the scheduling and availability of the Client and writer. The Client may upgrade or order a custom bespoke package by written request.

You agree that you will use our services in compliance with all applicable local, state, national, and international laws, rules, and regulations. Furthermore, you agree that you will not request or submit a work product that is unlawful, defamatory, profane, vulgar, racial, harassing, hateful, ethnic, abusive, fraudulent, obscene, or otherwise objectionable. You further agree not to request or submit a work product that relates to illegal activity. The Client warrants to and in favor of Rich Book Authors that any information, including but not limited to, written works, images, footage, online content, documents, or designs provided by the Client to Rich Book Authors in connection with Products and/or Services is free from any copyright and/or does not infringe upon any rights of any third party to which the Information belongs or all fees, royalties, and payments have been made to and permissions granted from the lawful copyright owner. Further, Rich Book Authors reserves the right to refuse service to anyone at any time without notice for any reason. Rich Book Authors will not be responsible or liable for the exercise or non-exercise of its rights under this Agreement.

Rich Book Authors creates a custom book cover design for e-book, paperback, and hardcover books with one change request.

Rich Book Authors customizes design layout for print and e-book.

Rich Book Authors offers support securing your ISBN Assignment, U.S. Copyright Registration, and Library of Congress Control Number (LCCN).

Rich Book Authors offers the full Client coordination to create their KDP, Ingram, and other distribution accounts for the Client's book to be available on (Amazon, Ingram, Apple iBooks, B&N.com, Kobo, and Google Play), and everywhere readers buy books traditionally.

Rich Book Authors require the Client to edit and proofread each book chapter to submit a final saleable and marketable manuscript product. The Client is limited to three rounds of editing before final typesetting.

Upon delivering the final work product, the Client shall have seven business days to request further revisions. After seven days have passed, the project shall be deemed closed, and no other modifications will be allowed to be made to the Client's final manuscript.

Rich Book Authors positions the Client's book to succeed in the marketplace to become a best-selling author in a specific Amazon category.

Rich Book Authors provides its Clients upon request a free course that teaches authors once published six and seven principles on coaching, courses, speaking, consulting, live events/speaking engagements, virtual training, brand partnerships, movies, and merchandising.

Rich Book Authors either get your book on a bestseller list or receive a partial refund of five percent of the total amount of the Client book package.

Rich Book Authors charges a flat rate for the Compact, Complete, and Full-Length Book Packages for Clients on installment payment plans. Each Client will be sent an invoice to choose their preferred payment method via PayPal, CashApp and QuickBooks payment processing confirming their initial installment payment or full payment to be rendered at the onset before the interview-based book writing process begins. You shall also pay any taxes imposed by governmental agencies of whatever kind and assessed with respect to all transactions under the Agreement, including penalties and interest (if any). When Rich Book Authors' have the legal obligation to pay or collect such taxes, the appropriate amount shall be billed to and paid by the Client. Delinquent payments shall bear interest at the rate of one-and-one-half percent per month (or the highest rate permitted by law, if less) from the due date until paid in full. You will be responsible for all reasonable expenses (including attorneys' fees) incurred by Rich Book Authors in collecting unpaid or delinquent amounts. All payments due are in U.S. dollars unless otherwise agreed in writing. All materials prepared by Rich Book Authors are copyright Rich Book Authors until full payment has been made.

No refunds. No cancellations. All Rich Book Authors Book Packages are non-refundable. Given the nature of our products and services, refunds are not available to Clients after a purchase. Refunds are not available for Clients who have violated the terms of services.

Rich Book Client Services are completed online; therefore, communication will be limited to emails and phone calls, and Rich Book Authors has the sole discretion to schedule Zoom or Otter AI meetings. Communication shall be sent via email to the email address provided to the email address used to communicate with Rich Book Authors by the Client. All emails shall be deemed received upon dispatch.

UNDER NO CIRCUMSTANCES SHALL RICH BOOK AUTHORS OR RESEARCHERS BE LIABLE TO YOU FOR ANY AMOUNT FOR SERVICES RENDERED OR INFORMATION PROVIDED PURSUANT TO THIS AGREEMENT; RATHER, YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE THE REFUND OF FEES ACTUALLY PAID BY YOU TO RICH BOOK AUTHORS FOR ANY INSTANCE OF USE OF THE SERVICES THAT GIVES RISE TO A CLAIM. TO THE EXTENT THAT ANY OF OUR WORK PRODUCTS REFERS TO ANY PRODUCT, MANUFACTURER, DISTRIBUTOR, COMPANY, SERVICE, OR SERVICE PROVIDER, RICH BOOK AUTHORS EXPRESSLY DISCLAIMS ANY ASSOCIATION WITH, ENDORSEMENT OF, OR LIABILITY FOR ANY SUCH PRODUCT, MANUFACTURER, DISTRIBUTOR, COMPANY, SERVICE OR SERVICE PROVIDER. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusions may not apply to you.

You agree to hold harmless and indemnify Rich Book Authors and its Counselors, employees, agents, and representatives from and against any third-party claim arising from or in any way related to your use of the service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorneys' fees, of every kind and nature. Rich Book Authors will provide you with written notice of such claim, suit, or action in such a case.

To the maximum extent permitted by applicable law, you hereby release and waive all claims against Rich Book Authors and its employees and agents from any and all liability for claims, damages (actual and consequential), costs and expenses (including litigation costs and attorneys' fees) of every kind and nature, arising out of or in any way connected with the use of the service.

In the event, the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The Arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

You shall not assign this Agreement or assign any rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without Rich Book Authors' prior written consent. Any such purported assignment or delegation by you without Rich Book Authors' prior written consent will be null and void and of no force or effect unless otherwise expressly consented to by Rich Book Authors at its sole and absolute discretion.

You hereby agree that any and all claims arising under this contract shall be governed by the laws of the State of Nevada, and any and all claims will be litigated only in the State of Nevada.
